Mt. Olympus Training Membership Agreement
This Membership Agreement is entered into by and between Mt. Olympus Training ("MTO") and the undersigned member {name} . By signing this Agreement, the Member agrees to the following terms and conditions:
1. Membership Plans and Fees
1.1 Membership Options:
Members may choose from the following membership plans:
- Monthly Membership
- Quarterly Membership
- Annual Membership
1.2 Training Programs:
Members will enroll in one of two training branches:
- Sports Training
- Adult Training
2. Payment Terms
2.1 Payment Method:
All payments must be made via automatic credit card withdrawal.
2.2 Payment Schedule:
Membership fees are due on the 1st of each month.
2.3 Late Payments:
A late fee of $20 will be charged for payments not made within 5 days of the due date.
2.4 Automatic Renewal:
Memberships automatically renew annually, locking in the current rate unless the membership is canceled or the applicable discount ends.
3. Cancellation and Refund Policy
3.1 Cancellation Notice:
Members may cancel their membership with a 30-day written notice, submitted via email to info@mtotraining.com.
3.2 Early Cancellation Fee:
A $50 cancellation fee applies for early termination.
3.3 Refunds:
All membership payments are non-refundable.
3.4 Trial Period:
Members may cancel within the first 30 days without penalty.
4. Member Conduct and Responsibilities
4.1 Code of Conduct:
Members must adhere to the following rules:
- No discrimination or abuse, whether physical or mental.
- Maintain cleanliness and safety at all times.
4.2 Dress Code:
Appropriate workout attire is required. No revealing undergarments or exposed side chest areas.
4.3 Equipment Responsibility:
Members are encouraged to bring personal floor mats or athletic gear for stability or comfort, but all necessary training equipment is provided by MTO.
5. Waiver of Liability
5.1 Assumption of Risk:
By signing this Agreement, the Member acknowledges and accepts the inherent risks associated with physical training and the use of fitness equipment.
5.2 Waiver of Claims:
The Member waives any claims against Mt. Olympus Training for injuries, including those that may arise due to pre-existing health conditions.
5.3 Specific Training Risks:
The Member acknowledges that specific training types, such as weightlifting and high-intensity workouts, carry additional risks, which are also waived.
6. Health and Fitness Assessments
6.1 Health Questionnaire:
All members are required to complete a fitness assessment or health questionnaire before beginning training.
6.2 Medical Clearance:
A doctor's note is not required unless specifically requested by MTO staff.
7. Trainer/Staff Obligations and Liability
7.1 Trainer Liability:
Trainers are not liable for any injuries sustained during training sessions.
7.2 Individualized Plans:
Trainers will develop individualized plans based on a general training framework.
8. Facility Use and Access
8.1 Training Hours:
MTO operates based on seasonal schedules, offering training sessions in the early morning, mid-morning, and afternoon. Specific schedules are posted online.
8.2 Special Access:
Access to The House Barbell Club is strictly through a membership with The House Barbell Club. MTO training sessions are separate from general gym access.
8.3 Guest Policy:
Guests are welcome to one free training session after signing up as a guest through MTO’s website.
9. Suspension and Termination of Membership
9.1 Grounds for Termination:
MTO may terminate memberships for rule violations, non-payment, or misuse of the facility.
9.2 Membership Suspension:
Memberships may be temporarily suspended due to injury, illness, or caretaking responsibilities (e.g., sick parent or child). Members should notify their coach to arrange a freeze.
10. Medical Emergencies and Insurance
10.1 Insurance Requirement:
Members are not required to provide proof of insurance before joining.
10.2 Medical Expenses:
MTO is not responsible for medical expenses incurred from injuries sustained during training.
11. Photography and Media Release
11.1 Consent for Media Use:
By signing this Agreement, the Member grants MTO permission to use photographs and videos taken during training sessions for promotional purposes.
11.2 Opt-Out:
Members do not have the option to opt-out of media usage.
12. Dispute Resolution
12.1 Mediation and Arbitration:
All disputes arising from this Agreement must first be submitted to mediation. If unresolved, the dispute will proceed to arbitration. Only after arbitration may legal proceedings be initiated.
12.2 Jurisdiction:
All legal proceedings will be governed by the laws of the State of Illinois and handled in local courts in Peoria, IL.
13. Force Majeure and Closure Policies
13.1 Facility Closures:
MTO reserves the right to cancel classes or close the facility at any time for reasons beyond its control (e.g., natural disasters, pandemics).
13.2 Compensation for Closures:
Members may request compensation for extended closures by contacting MTO via info@mtotraining.com.
14. Non-Solicitation and Non-Compete
14.1 No Solicitation:
Members are prohibited from offering products or services within the premises of The House Barbell Club and Mt. Olympus Training.
14.2 Trainer/Staff Restrictions:
Trainers and staff are prohibited from soliciting or "poaching" MTO clients for personal business or external training.
15. Data Privacy and Confidentiality
15.1 Data Protection:
Member information will be stored in the GymDesk platform, which is responsible for safeguarding data. MTO will not be liable for any loss of information.
15.2 Confidentiality:
All member fitness information is confidential and will be shared only between the Member and their assigned coach.
16. Parental Consent for Minors
16.1 Age Requirements:
There is no minimum age limit for membership. However, minors under the age of 18 must have a parent or guardian's consent.
